Welcome to evrhaven ("Service"), operated by evermed research ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our family law case management platform, including the AI-powered assistant, document analysis, Gmail integration, and related features. By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Service.

evrhaven is NOT a law firm and does NOT provide legal advice. The Service is an informational and organizational tool only. The AI assistant provides general information based on your inputs but cannot and does not replace consultation with a licensed attorney.

  • Do NOT rely solely on evrhaven for legal decisions affecting your family, custody, property, or finances.
  • Always consult a licensed attorney in your jurisdiction before taking legal action.
  • AI-generated analysis may contain errors, omissions, or outdated information.
  • Court filings, deadlines, and procedures vary by jurisdiction and change over time.

By using evrhaven, you acknowledge that you understand this limitation and will not hold us liable for any outcomes resulting from your use of or reliance on the Service.

1. Eligibility

  • You must be at least 18 years old to use the Service.
  • You must have the legal capacity to enter into binding agreements.
  • If you are using the Service on behalf of another person (e.g., as their representative), you must have their authorization to share their information.

2. Account Registration

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.
  • We may suspend or terminate accounts that violate these Terms.

3. Subscription Plans & Billing

A. Plans

We offer subscription plans with varying features, credit allowances, case limits, and access durations. Plan details are displayed at the time of purchase and on your account page.

B. Credits

Credits are consumed when using AI features (chat, document analysis, etc.). Credit usage varies by feature. Credits do not roll over between billing periods unless explicitly stated.

C. Renewals

Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time through your account settings or payment provider.

D. Refunds

Subscription fees are generally non-refundable. If you believe you are entitled to a refund due to technical issues, please contact us at evermed@evermedresearch.org.

4. Data Retention & Deletion

A. Active Subscriptions

While your subscription is active, your cases, documents, chats, and other data are retained and accessible through the Service.

B. Expiration & Grace Period

When your subscription expires, you have a 3-day grace period to renew your plan. During this period, your data remains intact but you may have limited access to features.

C. Automatic Data Deletion

After the 3-day grace period, your case data, documents, chats, and uploaded files will be permanently deleted. This deletion is automatic and irreversible. Your account will remain so you can subscribe again, but your previous case data cannot be recovered.

We strongly recommend downloading any important documents or information before your subscription expires.

D. Legal Holds

In certain circumstances (e.g., legal proceedings, subpoenas, or regulatory requirements), we may be required to preserve your data beyond normal retention periods. Such holds override the standard deletion schedule and are implemented only when legally required.

5. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws.
  • Upload content that is defamatory, obscene, or violates others' rights.
  • Attempt to gain unauthorized access to the Service or other users' accounts.
  • Use the Service to harass, threaten, or intimidate any person.
  • Interfere with or disrupt the Service or servers.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Use automated systems (bots, scrapers) without our written permission.
  • Resell or redistribute the Service without authorization.

6. Content Ownership

A. Your Content

You retain ownership of content you upload (documents, case information, etc.). By uploading content, you grant us a limited license to process, store, and display it solely to provide the Service to you.

B. Our Content

The Service, including its design, features, AI models, and documentation, is owned by evermed research and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

7. Third-Party Services

The Service integrates with third parties (e.g., Gmail, AI providers). Your use of these integrations is subject to their respective terms and privacy policies. We are not responsible for third-party services' availability, accuracy, or conduct.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • We do not warrant that the Service will be uninterrupted, secure, or error-free.
  • We do not warrant the accuracy, completeness, or reliability of any AI-generated content.
  • We do not warrant that the Service will meet your specific requirements.

9. Limitation of Liability

To the maximum extent permitted by law, evermed research and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from:

  • Your use of or inability to use the Service.
  • Any decisions or actions you take based on information from the Service.
  • Unauthorized access to your account or data.
  • Errors, inaccuracies, or omissions in AI-generated content.
  • Any legal outcomes in your family law matter.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless evermed research and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

  • You may terminate your account at any time by contacting us.
  • We may suspend or terminate your access at any time, with or without cause or notice.
  • Upon termination, your right to use the Service ceases immediately.
  • Sections regarding liability, indemnification, and governing law survive termination.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice in the Service. Your continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and evermed research regarding the Service and supersede any prior agreements.
